Pursuant to the Fantasy Sports Act of 2016 and Rule 1360-03-05-.12, fantasy sports operators are required to submit an annual audit, which includes the following two components:
- A financial audit prepared by a certified public accountant, consistent with the attestation standards established by the American Institute of Certified Public Accountants, of the fantasy sports operator’s financial operations and handling of player accounts and funds pursuant to the Fantasy Sports Act; and
- A compliance audit to verify compliance with the operational aspects of the Fantasy Sports Act, including those set forth in Tenn. Code Ann. 47-18-5605, and to verify the integrity of the computer operating systems used to operate the fantasy sports contests.
The Secretary of State has approved the following two testing laboratories to perform the compliance audit:
815 Pilot Road, Suite G
Las Vegas, Nevada 89119
Gaming Laboratories International
600 Airport Road
Lakewood, New Jersey 08701 USA
Eclipse Compliance Testing
6401 Davis Industrial Parkway
Solon, Ohio 44139 USA
Fantasy Sports operators may also seek recognition of an alternative laboratory for use in completing the compliance audit by submitting a written request to Mary Beth Thomas via email at email@example.com. Our office will review the qualifications and experience of the gaming laboratory and determine whether to recognize that entity as an approved provider.
Annual audit reports are due no later than the first day of the fourth month following the close of the fantasy sport’s operator’s fiscal year.
