Where can I obtain a list of compliance auditors approved by the Secretary of State for Fantasy Sports Operators?

Pursuant to the Fantasy Sports Act of 2016 and Rule 1360-03-05-.11, fantasy sports operators are required to submit an annual audit, which includes the following two components:

  1. A financial audit prepared by a certified public accountant, consistent with the attestation standards established by the American Institute of Certified Public Accountants, of the fantasy sports operator’s financial operations and handling of player accounts and funds pursuant to the Fantasy Sports Act; and
  2. A compliance audit, prepared by a certified public accountant, testing laboratory, or other professional service provider recognized by the Secretary of State, to verify compliance with the operational aspects of the Fantasy Sports Act, including those set forth in Tenn. Code Ann. 47-18-1605, and to verify the integrity of the computer operating systems used to operate the fantasy sports contests.

Fantasy Sports operators may seek recognition of a certified public accountant, testing laboratory, or other professional service provider for use in completing the compliance audit by submitting a written request via email. Our office will review the qualifications and experience of the organization and determine whether to recognize that entity as an approved provider. Annual audit reports are due no later than the first day of the seventh month following the close of the fantasy sport’s operator’s fiscal year.
