Tennessee Code Annotated, section 66-2-301 et seq., requires certain foreign-party-controlled businesses that hold an interest in Tennessee non-agricultural land on or after January 1, 2025, to register their interest in the land with the Tennessee Secretary of State. The details of these requirements, including definitions, are contained in Public Chapter No. 995.

Certain entities must also register their interests in agricultural land with the Tennessee Department of Agriculture, and any questions concerning registration of interest in agricultural land should be directed to the Department of Agriculture.

To register an interest in non-agricultural land, an entity should file the Registration of Interest in Non-Agricultural Land form. Filing Instructions for this form:

· The Registration of Interest in Non-Agricultural Land must be signed by an authorized representative of the foreign-party-controlled business.

· Submit a separate registration for each interest in Tennessee non-agricultural land owned by a prohibited foreign-party-controlled business.

· Send the registration to: Tennessee Secretary of State, ATTN: Division of Business and Charitable Organizations, 312 Rosa L. Parks Ave., Nashville, TN 37243.
