How to File Rules and Notices

Important Update Regarding Filings

The Department of State has filed emergency rules that allow for electronic submission of signed rule filings, notices of rulemaking hearings, withdrawals, and stays. According to the rules 1360-01-01, 1360-01-02, and 1360-01-03, we will now accept three (3) original forms documents with original signatures in hard copy or a single PDF copy of the signed original form. Signatures may be affixed electronicallyNotarization or certification of signatures is no longer required. Electronic filings should be emailed to publications.information@tn.gov. We still require a Word document of the forms, and the Word document must be transmitted by email to the same email address as above.

As provided by T.C.A. Title 4 Chapter 5, the rules and regulations are the current and official rules and regulations presented as the official compilation-Rules and Regulations of the State of Tennessee and are inclusive of all amendments, repeals, and/or deletions.

 

1. Download and fill out the appropriate form then print copies of rules or 3 copies of hearing notices. Attach an additional redlined copy of rule amendments per T.C.A. § 4-5-226. Copies of the entire rule chapter are no longer necessary. For more information, go to 1360-01-02 Filing Rules.

Note: Pursuant to Tenn. Code Ann. § 4-5-229, any new fee or fee increase promulgated by state agency rule shall take effect on July 1, following the expiration of the ninety (90) day period as provided in § 4-5-207. This section shall not apply to rules that implement new fees or fee increases that are promulgated as emergency rules pursuant to § 4-5-208(a) and to subsequent rules that make permanent such emergency rules, as amended during the rulemaking process. In addition, this section shall not apply to state agencies that did not, during the preceding two (2) fiscal years, collect fees in an amount sufficient to pay the cost of operating the board, commission or entity in accordance with § 4-29-121(b).

2. Get the appropriate signatures on all copies, then submit to the Attorney General’s Office for review.

Once a signed copy is returned from the Attorney General's office, submit all copies and a digital file on CD to:

4. A signed copy will be returned to your agency.
5. Upon receipt and acceptance of the filing, the Division of Publications will determine the effective date.
