The records shall be retained in a safe and secure manner, for five years following the date of the notarization.
A backup of the electronic records shall also be maintained for five years following the date of the notarization.
A notary can elect to store such recordings with a custodian, or a repository and such recordings may be stored separately from the journal if it is cross-referencing the place of storage and how the record is stored.
The original records and backup shall be protected from unauthorized use.
What will I need to register to vote online?
You need an ID issued by the Tennessee Department of Safety and Homeland Security. We need your signature on file there to sign your application.
If you do not know your Department of Safety and Homeland Security ID number, do not worry. We will use the other information you enter to download your signature.

You do not have to re-register, but please go ahead and update your existing registration. Updating your name now keeps the rolls accurate and reduces the amount of paperwork you will have to fill out when you go vote.
Can I update my voter registration information through the online voter registration application?
Yes, you can use the system to update your name or address.
I'm registered with multiple vendors; do I have to update my remote online notary information with all their information?
Yes, each vendor that you are utilizing their software to remotely notarize documents should be listed in your dashboard under your vendor technologies. You have the option to add new vendor technologies in your dashboard for free. The same documents are required to be uploaded.
How do I get the books?
All special library materials--books, magazines and playback equipment--are circulated through the mail postage free. Patrons must borrow books each year to remain eligible for the service.
How do I start the service?
You must first complete an application for service and send it to the Tennessee library. All states provide the service for their residents.
How do I know what titles are available?
Bimonthly magazines will tell you about newly released books and related library services: Talking Book Topics and Braille Book Review. You may also order general catalogs. You can always call the library to ask about authors and titles. The National Library Service catalog is searchable online.
Can Non-resident Property Owners Register to Vote?
Otherwise qualified voters who own real property within a municipality in which they do not live may register to vote if the municipal charter extends the right to vote to non-resident property owners. Non-resident property owners must provide proof of property ownership at the time of registration. Consult local election commission offices for further information or the city attorney of the municipality in which property is owned. T.C.A. 2-2-107.
How do I play the talking books?
Special playback equipment is loaned to patrons who use the library service. Books and magazines in the TLABM collection are recorded at a slower speed than conventional recordings and the books require special players. Players are mailed to patrons postage free. The library repairs and replaces equipment as necessary. For patrons who wish to purchase their own equipment, a vendor list is available.
What are the online notary seal requirements?
In accordance with Tennessee Rule 1360-07-03-.04, an online notary public shall use an electronic seal that substantially conforms to the following design: a circular, square, or rectangular seal with the notary public's name as it appears on the commission printed at the top, the county of election printed at the bottom, the words 'Tennessee Notary Public' printed in the center, and the words "Online Notary Public" printed below. The electronic seal must also be accompanied by a statement of the date upon which the online notary public's commission expires.

Do you have a list of approved third-party vendors for Online Notaries?
No, the Tennessee Secretary of State does not recommend nor endorse any third-party vendors. Whatever platform you choose should provide identity proofing, credential analysis, and storage for your video recordings of notarial acts. It should also be capable of attaching your electronic seal, electronic signature, and electronic notarial certificate to an electronic document.

Will I be notified if my online voter registration has been received and is accepted?
Yes. Your county election commission will mail you a voter registration card when they have accepted your application. This can take up to three weeks.
Can I vote online?
No. You can vote in person during early voting or on Election Day, or you can absentee vote by mail if you meet certain requirements.
What is an Online Notary Public?
In April of 2018, the Tennessee Legislature passed Senate Bill 1758 known as the “Online Notary Public Act”. This Act went in effect as of July 1, 2019. The Act defines “Online Notarization” as “a notarial act performed by means of two-way video and audio conference technology…”. This means that the notary and the principal whose signature is notarized are not in the same place but interact remotely over the internet. All regular notary rules apply to these transactions including the requirement for the notary to confirm the identity and state of mind of the principal, the voluntary nature of the act and the legality of the document. This will require online notaries to have access to significant technological resources via a contract with a third-party online notary vendor. This Act authorizes Tennessee notaries to perform remote online notarizations after the completion of an application and approval from the Tennessee Secretary of State. Where do homeless persons register to vote?
In order to register to vote in Tennessee, a person does not have to live in a building. Instead, a person who finds himself or herself homeless must describe where the person usually stays or returns to when absent. This location may be the address of a shelter where the person stays or frequents, or it may be the description of a street corner where the person may often rest. A physical description of the location must be given so that the election commission knows in which voting precinct to place the person. T.C.A. 2-2-122.
The election commission must mail voter registration cards to people who register to vote by mail. Therefore, if a homeless person tries to register to vote by mail using an address where the person does not get the mail, the person will have to give a mailing address where he or she can receive mail. For example, a homeless voter may be able to use a shelter as a mailing address or the address of a family member or friend who agrees to receive the mail. Another option is to use General Delivery as a mailing address. However, please note that absentee ballot materials may not be mailed to “general delivery.” T.C.A. 2-2-115 and T.C.A. 2-6-202.
If the voter registration card is returned as undeliverable to the election commission, the voter will be mailed a confirmation notice and placed on inactive status. T.C.A. 2-2-115.
In addition, like all registered voters, a homeless person should let the county election commission know when there are any changes to the mailing address or address where the person is registered to vote.
How do I handle a complaint about the conduct of a Notary?
A Notary is considered a public official and may be removed from office just as any other official. Complaints concerning official misconduct should be directed to local Law Enforcement in the county in which the Notary is elected or in which the alleged misconduct occurred.
"Pursuant to Tenn. Code Ann. § 8-7-103, the District Attorney General has the duty of prosecuting all violations of state criminal statutes which occur in his or her district. This duty includes prosecutions of criminal acts committed by notaries. A citizen who wishes to file a criminal complaint against a notary public may do so by contacting the District Attorney General of the judicial district in which the alleged criminal conduct occurred and proceeding through the complaint process."
Additionally, as explained in the above opinion of the Attorney General, a notary may be removed from office through the ouster proceedings set forth in Tenn. Code Ann. § 8-17-101.

What is the difference between E-Notaries and Remote Online Notaries?
In e-notarization, the notarization uses digital signatures but must occur in the physical presence of the notary, similarly to a traditional/pen and paper notarization. In remote notarization, the person is not in the physical presence of the notary but is present through audio and visual equipment such as a webcam.
Can I register to vote online if I do not have an ID issued by the Tennessee Department of Safety and Homeland Security?
You will not be able to register online since we will not be able to download your signature.
You can still register to vote by filling out a paper form. Remember that you will need a federal or Tennessee government-issued photo ID when you vote in person.
